Case Law No.69/2023/AL on the jurisdiction of the Commercial Arbitration in resolving a dispute concerning Confidentiality Agreements and Non-Compete Agreements
Legal situation: Employees and employers enter into a Confidentiality and Non-compete Agreement regarding the prohibition on employees from engaging in similar work or competitive employment with the employer after the termination of the labor contract. If there is a dispute, it shall be resolved through commercial arbitration.
Legal resolution: In this case, the court must determine that the dispute concerning the Confidentiality and Non-compete Agreement between the two parties was separate from the labor contract and fell under the jurisdiction of Commercial Arbitration.
