Case Law No.67/2023/AL about the person who receives the tangible items when dividing common property
Legal situation: In the case of dividing common property, which involves ownership rights to a house and land use rights, one party is an elderly individual who has established, managed, and used the house and land stably and for a long duration. They express the desire to receive the house and land and pay the value of the other person’s share of the property. The house and land cannot be physically divided.
Legal resolution: In this case, the court shall decide to hand over the land and house to the elderly person and the elderly person has to pay the value difference of the property to the other party.
