Case law No.68/2023/AL regarding the right to inherit kind heritage, which is a house, by an heir who is a Vietnamese residing abroad
Legal situation: The deceased’s inheritance comprises the right to own a house and the right to use property that existed before to the implementation of Law on Land 2013 and Law on Housing 2014. Disputes over inheritance assets shall be addressed by the Court during the period in which the Law on Land 2013 and Law on Housing 2014 were in force.a
Legal resolution: In this case, the Court shall apply Law on Land 2013 and Law on Housing 2014 for settlement.
In the event that there is an heir who is a Vietnamese residing abroad, the heir is entitled to inherit the estate in kind, which includes a house, provided they meet the conditions for receiving a house under Law on Housing 2014. The inheritance can be divided in kind.
